In Canada, employers are legally entitled to ask job applicants about convictions under the Canadian Criminal Code. They can also ask about convictions for provincial offences such as speeding or securities violations. However, in many provinces it’s illegal to refuse employment based on a criminal conviction unless the employer can demonstrate it directly impacts the person’s ability to do the job.
US Background Screening Compliance
Under federal Equal Employment Opportunity Commission laws, US employers can ask about criminal history information, but how and when it happens varies by jurisdiction. In California, The Fair Chance Act generally prohibits employers from asking job candidates about their criminal history on a job application or during an initial interview. This type of law is also known as a “Ban the Box” law. In contrast, Texas has no laws restricting employers from asking about an applicant’s criminal background. As a result, employers in Texas can ask about your criminal history on a job application or during an interview.
What’s more, in the US, the FCRA mandates employers to notify individuals when adverse action is taken based on information obtained from a background check. When an employer decides not to hire, promote, or retain an individual based on information found in their background check, they must provide the individual with an adverse action notice. This notice informs the individual of the adverse decision and provides them with specific details, such as the name and contact information of the consumer reporting agency that provided the report, as well as information about their rights under the FCRA.
The purpose of the adverse action notice is to ensure transparency and fairness in the employment screening process and to give individuals the opportunity to review and dispute any inaccurate information in their consumer report. It helps protect individuals’ rights and promotes accountability among employers and consumer reporting agencies.
